These Terms and Conditions govern your use of the CityGolf Boston website and your participation in the CityGolf Boston text messaging program. By using our website or opting in to receive text messages from us, you agree to these Terms and Conditions.

CityGolf Boston (“CityGolf,” “we,” “us,” or “our”) provides golf instruction, indoor golf simulator access, memberships, club fitting, golf equipment, junior golf programs, events, and related products and services.

SMS/Text Messaging Program

When you provide your mobile telephone number and expressly agree to receive text messages from CityGolf, you authorize us to send recurring SMS or MMS messages to that number.

Messages may include:

  • Special offers, promotions, and discounts

  • Information about golf lessons, memberships, and simulator access

  • Event and junior-program announcements

  • Appointment, reservation, membership, and service updates

  • Other CityGolf news and marketing communications

Message frequency varies. You may receive up to four marketing messages per month, in addition to any transactional or service-related messages you request.

Consent to receive marketing text messages is not a condition of purchasing any product or service from CityGolf.

How to Opt Out

You may cancel your participation in the text messaging program at any time by replying STOP to any CityGolf text message.

After submitting a STOP request, you may receive a final message confirming that you have been unsubscribed. After that confirmation, you will no longer receive marketing text messages from us unless you opt in again.

Other commonly recognized opt-out requests, such as CANCEL, END, QUIT, or UNSUBSCRIBE, may also be honored where supported.

Message and Data Rates

Message and data rates may apply to SMS and MMS messages sent to or received from CityGolf. The charges, if any, are determined by your wireless carrier and mobile service plan.

CityGolf does not charge a separate fee for participating in its text messaging program.

Wireless Carrier Disclaimer

Delivery of text messages is subject to effective transmission by your wireless carrier and is not guaranteed. Wireless carriers are not responsible for delayed or undelivered messages.

CityGolf and its service providers are not liable for delayed, failed, or misdirected delivery caused by circumstances outside their reasonable control, including carrier or network availability.

Eligibility and Mobile Number Responsibility

You must be at least 18 years old, or have the permission of a parent or legal guardian, to participate in the text messaging program.

By opting in, you confirm that:

  • You are the subscriber or customary user of the mobile number provided;

  • You are authorized to consent to receive messages at that number; and

  • The information you provide is accurate.

If you change or discontinue your mobile number, you agree to opt out or notify CityGolf so that messages are not sent to a person who later receives that number.

Privacy

Your participation in our text messaging program is also governed by our Privacy Policy, which explains how we collect, use, and protect personal information.

Mobile information will not be sold or shared with third parties for their own marketing purposes. Text messaging originator opt-in data and consent will not be shared with third parties, except with service providers acting on our behalf as necessary to operate the messaging program or as required by law.

We make reasonable efforts to keep the information on our website accurate and current. However, prices, schedules, availability, program details, products, services, and promotions may change without notice.

Purchases, appointments, memberships, lessons, events, and other CityGolf services may be subject to additional terms presented at the time of purchase or booking.

Orders

We request information from you on our order form. To buy from us, you must provide contact information (like name and shipping address) and financial information (like credit card number, expiration date). This information is used for billing purposes and to fill your orders. If we have trouble processing an order, we’ll use this information to contact you.

We have a no-refund policy.

Acceptable Use

You agree not to misuse our website or services, interfere with their operation, attempt to gain unauthorized access to any system, or use the website for unlawful or fraudulent purposes.

All website content, including text, photographs, graphics, logos, and other materials, is owned by or licensed to CityGolf and may not be reproduced or used without permission, except as permitted by law.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Your continued use of the website or participation in the text messaging program after a revision becomes effective constitutes acceptance of the revised terms, to the extent permitted by law.

Governing Law

These Terms and Conditions are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles.
